Charter Agreement

Effective October 29, 2026 · Version 8 · Summit Jet LLC

The agreement you accept when you pay for a flight on Summit Jet.

In short:
  • Summit Jet arranges your flight. A licensed FAA Part 135 operator flies it.
  • Pay in full to confirm. Card and Apple Pay are charged the Total. Crypto and wire get the discounts shown. Wire payers save a backup card (nothing is charged), which is charged only if the wire misses its deadline.
  • Non-refundable once paid, including no-shows. If the operator or we cancel and can’t rebook you, you get a full refund.
  • Extra costs (like waiting time or de-icing) are itemized and sent to you first. If you don’t respond after two notices over 5 business days, they may be charged to your saved card.
  • Photos are for illustration: your aircraft may look different, but it will be the model shown. If the model changes, we tell you before you pay.

01Parties and our role

This Charter Agreement (“Agreement”) is between you, the person who books and pays (“Customer” or “you”), and Summit Jet LLC, a Florida limited liability company (“Summit Jet,” “we” or “us”). It applies to every flight you book and pay for on flysummitjet.com and forms part of our Terms of Service. If this Agreement and the Terms differ, this Agreement controls for your booking.

Summit Jet is an air charter broker. We are not an air carrier. We do not own, operate, maintain or crew aircraft. Every flight is operated by an independent air carrier certificated by the FAA under Part 135, or by the foreign equivalent for international flights (the “Operator”). The Operator has full operational control of the flight and carries it under its own certificate, operations specifications and insurance.

Our role is to find and arrange your flight, collect payment on behalf of the Operator, issue your confirmation and boarding pass, and support you before and after the trip.

02Disclosures required by DOT (14 CFR Part 295)

  • Summit Jet is acting as an air charter broker on your behalf and is not the direct air carrier.
  • The Operator performing your flight is named on your trip page or in your confirmation before departure. On request, we will give you the Operator’s FAA certificate number.
  • The Operator maintains aircraft liability insurance as required by federal regulations.
  • The total shown at checkout includes all charges Summit Jet collects for the flight, including applicable federal excise tax and segment fees. Possible extra charges are described in Section 7.

03Eligibility and acceptance

You confirm that you are at least 18 years old and can enter into a binding contract, and that you are authorized to book for every passenger on the trip.

You accept this Agreement by ticking the acceptance box at checkout and paying, by confirming in writing, or by making any payment toward the trip. Your electronic acceptance is a legally binding signature under the federal ESIGN Act. We keep a record of the date and time, the version of this Agreement you accepted, and technical details of the device and connection used.

04Price and payment

The Total shown at checkout is the price for your trip. Payment in full is required to confirm the booking. Available methods:

  • Card or Apple Pay: charged the Total when you pay.
  • Cryptocurrency: the Total less the crypto discount shown at checkout. The amount is converted to U.S. dollars at checkout by our payment processor.
  • Bank wire: the Total less the wire discount shown at checkout. Include your booking code as the reference. Your trip is confirmed when the full amount arrives in our account. The Wire Deadline is shown with the wire details. It is two (2) business days after you request them, and never later than 48 hours before departure.
  • Zelle: the Total less the Zelle discount shown at checkout, sent to Summit Jet LLC’s Zelle tag shown at checkout, with your booking code in the memo. Your trip is confirmed when the full amount arrives. Zelle limits are set by your bank; if your limit is lower than the amount, pay by another method.
  • Backup card for wire. To receive wire details, you save a backup card. Nothing is charged or held at that time. If the full wire has not arrived by the Wire Deadline, we send you a notice, and if it still has not arrived 24 hours later, you authorize us to charge the backup card the Total (the card price, without the wire discount). If we cannot collect payment by either method, the Operator may release the aircraft and the booking may be cancelled. The full terms are in the Payment Terms.

Card and crypto payments are processed by our payment partner, Whop. Summit Jet never sees or stores your full card number. Payment terms are set out in more detail in the Payment Terms, which form part of this Agreement.

05Cancellations and refunds

Please read carefully. Bookings are non-refundable once paid, because we commit to the Operator on your behalf as soon as you pay.

  • If you cancel, do not show up, are refused boarding, or decide not to travel for any reason, no refund is due.
  • If the Operator or Summit Jet cancels and we cannot rebook you on a comparable flight that you accept, you receive a full refund of what you paid. You may choose a flight credit instead if you prefer.
  • Refunds go back to the original payment method. Card refunds usually appear within 5–10 business days, depending on your bank. Crypto payments are refunded in U.S. dollars, to the original method where our processor allows it, or otherwise by bank wire. Wire payments are refunded by wire.
  • If you need to change your trip, message us as early as possible. We will ask the Operator, but any change depends on availability and may cost extra.

When our service is delivered. Summit Jet provides two services: (a) booking, meaning arranging your flight with the Operator and issuing your confirmation and boarding pass, which is delivered when your booking is confirmed; and (b) flight facilitation, meaning the Operator making the aircraft and crew available at the departure FBO at the scheduled time, which is delivered when the aircraft is ready for you. Once both have happened, our obligations are fulfilled, whether or not you or your passengers choose to board. Your decision not to travel is not a failure to deliver the service.

06Empty legs and shared flights

Empty legs are repositioning flights that depend on the Operator’s main trip. Their date, time, route or aircraft can change, or the flight can be cancelled, if that trip changes. Shared flights may need a minimum number of passengers. A change made by the Operator is not a breach of this Agreement. If it makes the flight unusable for you, Section 5 applies and you will be refunded.

07Extra charges and card on file

Your Total covers the flight as booked. Costs that arise from your trip may be charged separately. Examples are extra waiting time or crew delay, a changed itinerary or extra stops, de-icing, special catering, international handling, permits or customs fees, cleaning beyond normal use, damage to the aircraft, and charges imposed by the Operator or an airport authority. Extra charges must be reasonable, customary and documented by the Operator.

Card on file. When you pay by card or Apple Pay, you agree that your payment method may be securely saved by our processor and charged later for these extra charges. Summit Jet never sees or stores your full card number.

Notice first. Before charging anything, we send you an itemized notice by email and in your trip messages. If you have a question, reply and we will resolve it with you first. If you do not respond after at least two notices over at least five (5) business days, we may charge the documented amount to your saved payment method. You receive a receipt for every charge.

Extra charges may be billed within sixty (60) days after the flight, based on the Operator’s invoice. If no payment method is saved, we send you an invoice that is payable within 7 days. If a charge to your saved payment method is declined, you must provide another valid payment method within 48 hours of our notice.

Usage-based in-flight services, such as satellite Wi-Fi or calls, are billed at the rate the Operator or crew discloses before you use them.

08Flight operations

  • Captain’s authority. The pilot in command has final authority over safety, including delaying, diverting or cancelling a flight.
  • Aircraft substitution. The Operator may substitute an aircraft of the same or a higher category for operational, mechanical, safety or regulatory reasons. A comparable substitution is not grounds for a refund.
  • Mechanical issues. If the aircraft cannot fly, the Operator will try to provide a comparable aircraft or a new time. If neither works for you, Section 5 applies.
  • Events outside anyone’s control include weather, air traffic control, airport closures, government orders, security or customs requirements, strikes, war or terrorism. If a flight cannot operate for these reasons, we will try to reschedule it. If that is not possible, Section 5 applies.
  • Aircraft photos. Photos on flysummitjet.com, in emails and in your confirmation are for illustration. The aircraft you fly may look different, including its paint, colors, interior design, finishes and seat layout, but it will be the aircraft model shown on your booking.
  • Change of aircraft model before you pay. If the aircraft model for your trip changes before you pay, we will tell you the new model before you pay, and you can decide whether to continue. After you pay, the substitution rules above apply.

09Passengers, documents and baggage

  • Every passenger must carry valid government photo ID and, for international flights, a passport and any visas or health documents required. Missing documents are treated as a customer cancellation.
  • Arrive at the private terminal (FBO) at least 15 minutes before departure, or earlier if we tell you to. If you are not there by the scheduled departure time, the flight may depart without you at the Operator’s discretion. This counts as a no-show: no refund is due, and you remain responsible for the full price and any extra charges.
  • Baggage limits depend on the aircraft. Hazardous or illegal items are not allowed. Baggage claims are handled under the Operator’s terms and applicable federal law.
  • The crew may refuse boarding to anyone who is intoxicated, disruptive, a safety risk or without proper documents. No refund is due in that case.
  • Operator documents. The Operator may ask you or your passengers to complete or sign its own documents before the flight, such as a passenger manifest, a waiver or a charter acknowledgment. If a required document is not completed before departure, the Operator may refuse the flight. This counts as a customer cancellation under Section 5, and Summit Jet is not liable.

10Payment disputes

If you think a charge is wrong, contact us first at hello@flysummitjet.com within 30 days. We will reply within 2 business days and try to resolve it within 15 business days. This does not limit your rights under the Fair Credit Billing Act or any other consumer protection law.

If a chargeback is filed for a flight that was made available as booked, or for a cancellation that is non-refundable under Section 5, we will provide this Agreement and your acceptance record to the card network.

Unpaid amounts and collection costs. You remain responsible for any amount owed under this Agreement, including an amount reversed by a chargeback that is not upheld. You agree to pay the reasonable costs of collecting it, including payment processor and chargeback fees, collection agency fees, court costs and reasonable attorneys’ fees, to the extent allowed by law.

Disputed or reversed payments before the flight. If a payment for your trip is disputed, charged back or reversed before departure, your booking is no longer paid. We will notify you, and if the full amount is not paid by another method within 24 hours, we may cancel the booking. This counts as a customer cancellation, not a cancellation by us.

11Liability

Because the Operator has operational control, Summit Jet is not liable for the performance of the flight, including delays, diversions, injury, or loss of or damage to baggage. Those matters are governed by the Operator’s terms and applicable law. To the fullest extent allowed by law, our total liability for any claim about a booking is limited to the amount you paid Summit Jet for that booking, and we are not liable for indirect or consequential losses such as missed connections or lost business. You are responsible for damage or loss caused by you or your passengers.

Your indemnity. You agree to indemnify and hold harmless Summit Jet and its owners, employees and agents from claims, damages, losses and costs, including reasonable attorneys’ fees, that arise from your breach of this Agreement, from the negligence, misconduct or unlawful acts of you or your passengers or guests. You are not responsible for the acts of the Operator or its crew, or for the operation, maintenance or airworthiness of the aircraft.

12Governing law and general terms

Changes to this Agreement. Your booking can be changed only in writing, including by email or in your trip messages, agreed by both you and Summit Jet. No one can change these terms verbally. We may publish a new version for future bookings; the version you accepted at checkout applies to your booking.

This Agreement is governed by the laws of the State of Florida and applicable U.S. federal law. Disputes will be heard by the state or federal courts in Broward County, Florida, though either of us may use small claims court where the claim qualifies. Notices may be sent by email or text message to the contact details on your booking. They are treated as received 24 hours after they are sent. If any part of this Agreement is unenforceable, the rest remains in effect. Nothing in this Agreement limits rights you have under consumer protection laws that cannot be waived by contract. This Agreement may be provided in other languages for convenience. If there is any difference between a translation and the English version, the English version controls.
